    Terms of Service

    Introduction

    These Terms of Service ("Terms") are a binding agreement between you and TheFlightApp ("we", "us", "our"), the operator of THE Flight App (the "App") and theflightapp.com (the "Site"). The App and the Site are together the "Service".

    By creating an account, starting a trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

    1. Who may use the Service

    You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority where you live) to purchase a subscription. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

    2. Your account

    You are responsible for your account credentials and for everything that happens under your account. Provide accurate information when you register, keep it current, and tell us promptly at support@theflightapp.com if you believe your account has been accessed without your permission.

    Much of the Service works without an account. An account is required only for features tied to you personally — saved flights and trips, badges, your flight passport, and delay monitoring.

    3. Subscriptions, trials and billing

    Free tier. Core flight lookup, live status, lounge information and airport data are available at no cost.

    Pro. Pro unlocks the features identified as Pro in the App at the time you subscribe. We may add to what Pro includes; if we remove a material Pro feature, we will tell subscribers in advance.

    Free trial. New subscribers may receive a 3-day free trial. Unless you cancel before the trial ends, the trial converts automatically into a paid subscription and the then-current price is charged.

    Price and renewal. Pro is $49.99 per year unless a different price is displayed to you at purchase. Subscriptions renew automatically for successive terms until cancelled. We will give notice before any price increase takes effect for your renewal.

    How you cancel depends on how you paid:

    • Purchased through Apple: your subscription is billed by Apple and governed by Apple's terms. Manage or cancel it in your Apple account settings. We cannot cancel or refund an Apple-billed subscription — refunds are at Apple's discretion under its policies.
    • Purchased through our website: billing is handled by our payment processor. Cancel from your account settings or by contacting support@theflightapp.com .

    Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial subscription periods. Nothing here limits any statutory right of withdrawal or refund you may have.

    Taxes. Prices exclude taxes unless stated. You are responsible for any taxes other than those on our net income.

    4. What the Service is — and is not

    The Service aggregates flight schedules, statuses, airport information, weather and historical patterns from third-party providers and public sources. It is an informational tool. In particular:

    • Flight information may be wrong, delayed or incomplete. Gates, terminals, baggage belts, times and aircraft assignments change without notice, and coverage varies by airline and airport. Some airports publish no gate data at all. Always confirm with your airline and with airport displays.
    • TSA wait times are estimates calculated from historical averages by day of week and hour of travel. They are not live measurements of any checkpoint.
    • Weather and delay outlooks are forecasts, not guarantees.
    • Seat and cabin specifications describe a typical layout for an aircraft type, not the specific airframe operating your flight. Airlines retrofit cabins without notice.
    • DelayPay identifies when a delay may make you eligible to seek compensation, and helps you assemble a request. It is not legal advice, we are not your lawyer or agent, we do not file claims on your behalf, and we do not guarantee that any airline will pay anything. Eligibility rules are set by regulators and airlines and can change.

    Do not rely on the Service for decisions where an error could cause you loss or harm — including whether to leave for the airport, whether you will make a connection, or whether to purchase or cancel travel.

    5. Acceptable use

    You agree not to:

    • use the Service unlawfully, or to infringe anyone's rights;
    • interfere with, disrupt, overload or probe the Service or its infrastructure;
    • circumvent rate limits, authentication, paywalls or other access controls;
    • reverse engineer, decompile or disassemble the App, except where that restriction is unenforceable by law;
    • misrepresent your identity or impersonate anyone;
    • resell, sublicense or provide access to the Service to third parties as if it were your own; or
    • use the Service to build, train or improve a competing product or dataset.

    6. Your content

    You keep ownership of what you put into the Service — your flights, trips, notes and profile. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to operate and improve the Service for you, including syncing it across your devices.

    That licence ends when you delete the content or your account, apart from backups retained for a limited period and anything we must keep by law.

    We do not sell your personal information, and we do not license your personal travel history to advertisers, data brokers or any other third party. Our handling of personal data is described in our Privacy Policy.

    7. Our data and content — restrictions on use

    This section is important. It governs everything the Service makes available to you that you did not create yourself: flight records, statuses, schedules, airport and lounge information, seat and cabin specifications, TSA estimates, delay statistics, weather outlooks, badges, artwork, text, layouts and software (collectively, the "Service Content").

    7.1 Licence to you

    We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service Content for your own personal, non-commercial travel purposes only.

    7.2 No commercial use

    You may not use the Service Content, in whole or in part, for any commercial purpose. Without limitation, you may not:

    • sell, licence, rent, lease, syndicate, or otherwise monetize any Service Content, whether alone or combined with other data;
    • redistribute or republish Service Content to third parties, including via an API, feed, spreadsheet, dashboard, newsletter or report;
    • use Service Content to operate or support any product, service or business, including a competing travel or flight-information product;
    • use Service Content to train, fine-tune, evaluate or ground any machine learning model, dataset or AI system; or
    • use Service Content in advertising or market research offered to others.

    7.3 No scraping or bulk extraction

    You may not use any robot, spider, crawler, scraper, script, headless browser, or other automated means to access, extract, index, copy or monitor any part of the Service or the Service Content. You may not bulk-download, systematically retrieve, or accumulate Service Content to create a database, archive, index or derivative collection, whether or not the result is distributed. This applies regardless of the volume extracted or the method used.

    7.4 No derivative datasets

    You may not create, distribute or make available any dataset, model, index, statistic or derivative work that is derived from or substantially based on the Service Content.

    7.5 What you may do

    You may view Service Content in the App, export your own flight history and passport, take screenshots, and share individual screens or flight details socially or with people you are travelling with, as long as you do not present the content as your own, remove attribution, or use it commercially.

    7.6 Third-party rights

    Some Service Content is licensed from third-party providers or is made available under open licences. Where a specific item of content carries its own licence terms and attribution, those terms control for that item and nothing in this Section 7 purports to restrict rights that licence grants you. Airline names, aircraft liveries, logos and marks belong to their respective owners and appear for identification only; we are not affiliated with, endorsed by, or acting as agent for any airline or airport.

    7.7 Aircraft artwork

    Illustrated aircraft shown in the App are our own brand artwork. They are not photographs of, and do not depict, the aircraft operating any particular flight.

    7.8 Ownership

    Except for your content and third-party content, the Service and Service Content are owned by us and protected by copyright, trademark, database and other laws. We reserve all rights not expressly granted.

    7.9 Enforcement

    We may suspend or terminate access, block addresses, and pursue any remedy available at law or in equity for a breach of this Section. A breach of Section 7 causes harm that money alone may not remedy, and we may seek injunctive relief without posting bond.

    8. Third-party services

    The Service depends on third parties, including flight-data providers, mapping and weather services, payment processors, and Apple's App Store. Your use of those services may be subject to their own terms. We are not responsible for third-party services, their availability, or the accuracy of data they supply.

    9. Availability and changes

    We may modify, suspend or discontinue any part of the Service at any time. We aim to give reasonable notice of material changes that reduce functionality you are paying for. We do not promise uninterrupted or error-free operation.

    10. Disclaimers

    THE SERVICE AND ALL SERVICE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

    WE DO NOT WARRANT THAT FLIGHT, AIRPORT, SECURITY, WEATHER, SEATING OR DELAY INFORMATION IS ACCURATE, CURRENT OR COMPLETE.

    Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

    11. Limitation of liability

    To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost data, or missed flights, connections, bookings or opportunities, arising out of or relating to the Service, whether based in contract, tort, strict liability or otherwise, and whether or not we were advised of the possibility.

    Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD $50.

    Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.

    12. Indemnity

    You will indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.

    13. Termination

    You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you would expose us to liability.

    Sections 4, 6 (final paragraph), 7, 10, 11, 12 and 15 survive termination.

    14. Changes to these Terms

    We may update these Terms. If a change is material, we will give reasonable notice — in the App, by email, or on the Site — before it takes effect. Continuing to use the Service after that date means you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription.

    15. Governing law and disputes

    These Terms are governed by the laws of the United States, without regard to its conflict-of-laws rules.

    Informal resolution first. Before filing anything, contact us at support@theflightapp.com and give us 30 days to try to resolve the issue.

    16. General

    These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
